DTMK Limited trades under two business names:
-
DTMK Training Services, delivering regulated qualifications and family and community-based training
-
DTMK Driving School, delivering learner driver tuition, advanced driver training, and related driving services

These Terms and Conditions apply to all services provided by DTMK Limited.
Where provisions differ, the relevant terms for Training Services or Driving School are clearly identified within this document.

2. Definitions
​

For the purposes of these Terms and Conditions:
-
Customer refers to any individual, company, organisation, school, nursery, youth group, or other entity booking services with DTMK Limited
-
Delegate refers to an individual attending a training course delivered by DTMK Training Services
-
Learner Driver refers to an individual receiving driving tuition from DTMK Driving School
-
Regulated Course refers to qualifications regulated by Ofqual and awarded through recognised awarding organisations
-
Family Course refers to non-regulated training delivered to members of the public and certificated by DTMK Limited

3. Booking and Confirmation
​
Training Services
-
Course bookings are not confirmed until written confirmation has been issued by DTMK Limited
-
Submission of a booking form confirms acceptance of these Terms and Conditions
-
Delegate substitutions may be permitted at the discretion of DTMK Limited, provided notice is given before the course start date
-
Where the Customer provides the venue, an accessibility statement and relevant risk assessments must be supplied in advance

Driving School
-
Learner Drivers must hold a valid UK category B provisional or full driving licence
-
Learner Drivers must disclose any medical, legal, or licensing matters that may affect their ability or entitlement to drive
-
Lessons are booked via the Total Drive app or directly with the instructor
-
Additional passengers are not normally permitted during lessons
-
Alternative pick up or drop off locations must be requested at the time of booking and are subject to instructor agreement
-
Where an alternative location is used, the Learner Driver is responsible for making their own arrangements to travel to and from that location
-
DTMK Limited is not responsible for providing, arranging, or reimbursing transport costs where a lesson is delayed, rescheduled, or cancelled
-
If a Learner Driver is not present within 10 minutes of the agreed lesson start time, the lesson will be cancelled and the fee forfeited

4. Payment Terms
​
Training Services
-
Family Courses must be paid in full at the time of booking
-
Commercial and corporate bookings are invoiced with 14-day payment terms, unless otherwise agreed in writing
-
Invoices must be paid by the due date stated on the invoice
-
Overdue invoices may incur interest at 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998

Driving School
-
All driving lessons are delivered in two-hour sessions
-
Lesson fees must be paid by the evening before the scheduled lesson
-
Block bookings must be used within six months, unless otherwise agreed
-
Credits within the Total Drive system are calculated as one credit equalling one hour of tuition
-
A standard lesson therefore uses two credits
-
Prepaid lessons are non-transferable
-
Payment methods accepted are bank transfer, which is preferred, or card payment via Total Drive where an administration fee applies
-
Cash payments are not accepted
-
Receipts are automatically issued by email through Total Drive

5. Cancellations and Refunds
​
Training Services
-
All cancellations must be submitted in writing to enquiries@dtmk.co.uk
-
Registered charities and members of the public attending Family Courses:
-
Seven days or more notice results in a full refund
-
Less than seven days’ notice results in a 100% charge
-
All other bookings:
-
Fourteen days or more notice results in a full refund
-
Less than fourteen days’ notice results in a 100% charge
-
DTMK Limited reserves the right to cancel or reschedule courses where necessary
-
Where DTMK Limited cancels a course, Customers will be offered an alternative date or a full refund
-
DTMK Limited accepts no liability for travel, accommodation, or other associated costs
-
Where required venue information, accessibility statements, or risk assessments are not provided within the required timeframe, or where the venue does not meet the requirements as described by the Customer, any postponement or cancellation will be deemed a cancellation by the Customer, and the applicable cancellation charges will apply

Driving School
-
A minimum of 48 hours’ notice is required to cancel or amend a lesson
-
Cancellations with less than 48 hours’ notice will be charged in full
-
Where DTMK Limited cancels due to instructor illness or vehicle fault, lessons will be rescheduled or refunded
-
No liability is accepted for additional costs incurred
-
Lessons may be cancelled or rescheduled by DTMK Limited due to adverse weather conditions where in the instructor’s professional judgement, it would be unsafe or unreasonable to proceed. In such circumstances, lessons will be rescheduled or refunded, and no cancellation charge will apply

6. Training, Lessons, and Attendance
​
Training Services
-
Delegates must attend all sessions in full. Late arrival or non-attendance may result in exclusion from the course without refund
-
Delegates should be aware that many courses require participants to act as a casualty for other members of the group as part of practical learning
-
Some sessions may involve the use of casualty simulation make up. Delegates are advised to dress accordingly and avoid clothing that may be easily stained
-
Practical activities may require kneeling or lying on the floor. Suitable clothing should be worn
-
Delegates must inform the trainer before the course begins of any injury, illness, medical condition, or previous experience that may affect their ability to participate in practical activities or relate to first aid topics
-
This information is required to enable appropriate reasonable adjustments to be considered
-
For regulated qualifications, photo identification must be provided at the start of the course. This is an awarding organisation requirement and failure to provide suitable identification may result in exclusion without refund
-
Some courses require pre learning to be completed prior to attendance. Where pre learning is not completed in full by the required deadline, this will be treated as a cancellation by the Delegate or Customer, and the applicable cancellation terms will apply
-
Delegates attending regulated qualifications must meet the required age, literacy, and competency criteria

Driving School
-
Learner Drivers must not attend lessons under the influence of alcohol, illegal drugs, or substances that impair driving ability
-
Learner Drivers must also consider the effects of prescription or over the counter medication and must not attend lessons where such medication may impair concentration, reaction times, or safe vehicle control
-
Suspected impairment will result in immediate lesson cancellation without refund
-
Learner Drivers must always follow instructor directions
-
Unsafe, abusive, threatening, or discriminatory behaviour or language towards DTMK Limited employees, other road users, DVSA staff, or members of the public will result in termination of tuition without refund
-
Traffic delays will be communicated via Total Drive where possible
-
Lessons may be extended or shortened by agreement where delays occur
-
Instructors are not responsible for personal belongings left in vehicles
-
Learner Drivers must provide licence check codes when requested and bring their driving licence to every lesson
-
Learner Drivers must always meet the legal eyesight standard
-
Where corrective eyewear is required but not worn or brought to the lesson, the lesson will be cancelled and the fee forfeited
-
Suitable clothing and footwear must be worn
-
Lessons may be cancelled without refund where clothing or footwear is deemed unsafe
-
During periods of increased community infection, additional hygiene or safety measures may be required

7. Venues, Vehicles, and Equipment
​
Training Services
-
Customer provided venues must be private, safe, and suitable for training delivery
-
Venues must comply with awarding body requirements and health and safety standards
-
All mains powered equipment used by DTMK Limited is Portable Appliance Tested
-
Suitable parking and safe loading and unloading areas must be provided for trainers
​
Driving School
-
Tuition vehicles are maintained in a clean, roadworthy, and dual controlled condition
-
Replacement vehicles may be used where necessary
-
Lessons in a Learner Driver’s own vehicle are permitted at the instructor’s discretion and subject to insurance and safety checks
-
Mechanical faults not caused by the Learner Driver will result in unused lesson time being credited
-
Faults caused by Learner Driver error will result in the lesson being lost but no repair costs charged
-
Learner Drivers are responsible for any fines, penalties, or offences committed during lessons

8. Practical Driving Test Arrangements
​

The Driver and Vehicle Standards Agency do not provide vehicles for practical driving tests
-
Use of a DTMK Limited vehicle for practical test purposes requires the Learner Driver to have completed the training syllabus to test standard
-
Learner Drivers must have passed two mock tests at least three weeks before the scheduled test date
-
DTMK Limited reserves the right to withdraw the use of its vehicle for a driving test where in the instructor’s professional judgement, it would be unsafe or inappropriate to proceed. The instructor’s decision is final
-
Where DTMK Limited cancels the use of its vehicle within 14 days of the test date due to instructor illness or vehicle breakdown, DTMK Limited’s liability is limited to reimbursement of the standard DVSA practical test fee only
-
Any additional costs incurred by the Learner Driver, including service or administration fees charged by third party booking services, are not the responsibility of DTMK Limited
-
The standard DVSA practical test fee is published on the government website and is subject to change
-
Instructor test day fees are charged at the normal lesson rate
-
Instructor accompaniment during the test is optional
-
Learner Drivers remain responsible for meeting all DVSA test requirements, which are available via the government website

9. Certification and Learning Resources
​
Training Services
-
Certificates are issued only where all course, assessment, and attendance requirements have been met, and no outstanding payment remains
-
All certificates are issued in digital format
-
Where an organisation or company makes a booking, certificates will be issued directly to the named booking contact for the purpose of maintaining training records
-
Certificates for Family Courses are issued to all attendees
-
Replacement certificates will incur an administration fee

Driving School
-
Theory learning resources may be provided where the Learner Driver maintains at least one two-hour lesson per month
​​

​
10. Health, Safety, and Equality
​
-
Learner Drivers and Delegates must declare any relevant medical or health conditions that may affect participation or safety
-
Any required emergency medication must be brought to sessions and remain the responsibility of the individual
-
Learner Drivers must always meet the legal eyesight standard and wear corrective lenses where required. Instructors may re check eyesight where there is a concern
-
DTMK Limited is committed to providing a safe learning environment and complies with all applicable health and safety legislation

DTMK Limited is committed to equality, diversity, and inclusion and complies with all applicable equality and discrimination legislation, including making reasonable adjustments where required
-
These commitments are supported by DTMK Limited policies, including Health and Safety, Equality and Diversity, and Safeguarding, which are available on request

11. Complaints and Appeals
​
Training Services
-
Complaints, appeals, and allegations of malpractice are managed in accordance with DTMK Limited formal policies
-

​
Driving School
-
Complaints should be addressed in the first instance to Christopher Cook, Managing Director

Where a complaint cannot be resolved directly, it may be escalated to the DVSA Registrar of Approved Driving Instructors, in accordance with DVSA procedures

12. Liability
​

DTMK Limited accepts no liability for loss or damage to personal belongings

Liability is limited to the amount paid for the relevant booking
-
Nothing in these Terms excludes liability for death or personal injury caused by negligence
-
Learner Drivers remain responsible for all driving offences, fines, and penalty points incurred

13. Data Protection and Privacy

DTMK Limited is registered with the Information Commissioner’s Office
-
Personal data is processed in accordance with UK data protection legislation
-
Records may be retained for a minimum of three years. Longer retention periods apply to some records as set out in the Privacy Policy and Data Retention Schedule.

14. Trainers and Instructors
​

All trainers and instructors engaged by DTMK Limited hold appropriate qualifications and experience for the services they deliver
-
Trainers delivering regulated qualifications hold relevant subject specific qualifications or are registered healthcare professionals, where required by the awarding organisation
-
Driving instructors engaged by DTMK Limited are one of the following:

Approved Driving Instructors
-
Licensed Trainee Instructors
-
Supervised trainee instructors
-

All staff engaged by DTMK Limited are Disclosure and Barring Service checked at an appropriate level and receive safeguarding training

15. Governing Law
​
-
These Terms and Conditions are governed by the laws of England and Wales.
Both parties agree to the exclusive jurisdiction of the courts of England and Wales.
​

​
16. Force Majeure
​
-
DTMK Limited shall not be liable for any failure to perform, or delay in performing, its obligations where such failure or delay arises from events beyond its reasonable control.
-
Such events may include, but are not limited to, severe weather conditions, acts or restrictions of government or public authorities, public health emergencies, industrial action, power or utility failures, fuel shortages, disruption to transport networks, or other circumstances which make the delivery of services unsafe, impractical, or impossible.
-
Where a force majeure event occurs, DTMK Limited will make reasonable efforts to reschedule the affected service. Where rescheduling is not possible, refunds will be issued in accordance with these Terms and Conditions.

DTMK Limited shall not be liable for any additional costs, losses, or expenses incurred because of a force majeure event.
